I. Introduction.
Pursuant to Articles 5, section II and 57 of the Federal Electricity Commission Law, the Federal Electricity Commission ("Commission") has as purpose, among others, to transport, store, purchase, and sell natural gas, for which it may act through subsidiary production companies and affiliates.
In its ordinary meeting dated November 10, 2015, the Board of Directors of the Commission authorized the organization of CFEnergía ("CFEnergía"), S.A. de C.V., as an affiliate with direct participation of the Commission. The corporate purpose of CFEnergía consists in, among others, the procurement of transport, storage, purchase, and sale of natural gas, as well as the management of assets and fuels. Pursuant to article 59 of the CFE Law, CFEnergía is governed by private law regulations.
CFEnergía also has permit H/8100/COM/2015 granted by the Energy Regulatory Commission pursuant to Resolution RES/769/2015 issued on November 15, 2015, which authorizes natural gas commercialization. Such commercialization includes its purchase and sale, as well as its management or procurement of the transport, storage, or distribution services.
Due to the above, and given the commitment of CFEnergía to help achieve energy security in the country guaranteeing the competitiveness of its services, in order for such conditions to be reflected in the generation of electricity and in the final price of electricity, based on article 134 of the Political Constitution of the United Mexican States, we hereby (the "Call") invite interested parties to participate in the Tender for the acquisition of a Mobile Unit Aeroderivative Gas Turbine for Baja California Sur ("Tender"), in the terms detailed below.
II. Tender Tender Purpose: obtain the best offer to purchase 3 (tree) or 4 (four) Mobile Unit Aeroderivative Gas Turbine that generates at least 108 MW, at Delivery Site conditions, as defined in this document, including training service and supervision service during the assembly and commissioning.
